By Henry Byers A court order that seizes assets from the defendant to pay off a debt is known as Garnishment. One form of garnishment is automatic withholding of the debtor’s wages. When a creditor fails to satisfy the debt taken, the court can issue a garnishment against him. When the creditor petitions the court to send a portion of its pay to satisfy the debt then this step is taken. The garnishment law differs from state to state and varies in details also. Generally, the TVA is required to take over 25% of an employee’s disposable earnings or assets, thereafter sending that amount to court. The pay of an employee can be under garnishment until the complete of the debt has been collected. This situation arises when we fail to pay taxes, skip out on child support or overlook some bills. Under these circumstances the state government or the creditor can seize our wages as well. This process is known as Wage garnishment. Most garnishment requires court orders and employers are supposed to notify the creditor before any step is taken. But garnishment is the last option for which a government goes for. It is taken up only after all other options have exhausted. One should never ignore IRS because due to ignorance there are chances of increase in garnishment, as they know our work place, living place and even the bank account. The loans or the help provided by the government are of many types such as student loan for education, business loan, child support, and etc. To collect the loans back, IRS is not alone but the state government, private creditors, or even an ex-spouse demanding the alimony can also demand garnishment of our pay. To claim the garnishment, only different branches of the government do not need to take court orders, other than every other agency needs to obtain a court order to claim the garnishment. Losing the income is not easy but there are some limits for garnishment. Title III of the Consumer Credit Protection Act caps the amount of wages that can be taken from an employee. In this manner, the person is also left with some part of the income as well as the creditor is also paid up. This also prevents the creditor to speed up the debt recovery procedure and harass the debtor. The level of garnishment is based on the disposable earnings of the employee. This amount comes after deducting the legal deductions of federal state and local taxes, social security, unemployment, insurance and state employee retirement system. Things that do not come in the head of voluntary deductions are union dues, health and life insurance, charity, purchase of savings bonds and payment for payroll advance. After taking all the preventative measures, the disposable income amount is calculated the maximum amount that can be garnished in any pay period should not exceed more than 25% of the employees’ disposable earning. The garnishment law allows up to 50% of the employees’ disposable income to be garnished, if he supports the wife and a child. The restrictions on garnishment do not apply in case of court orders of bankruptcy and outstanding debts of federal or state taxes. When the federal law differs from the state wage garnishment law, the smaller garnishment amount must be followed. Care should be taken to stay from the evil of garnishment. In some cases this situation occurs when a letter is received form the IRS department 20 days before the garnishment date. That time if the person goes to the IRS and explains the problem and repayment schedule or apologize and seeks more time for repayment then the problem at hand can be solved. If the creditor also has a problem he also needs to go to the court and seek an order for garnishment. Thus if the reason explained by the debtor is genuine then the department chalks out a repayment plan. But if the second chance of the repayment is also defaulted then further garnishment proceedings and called for. Lemons: This is about the only non-sweet fruit that I personally include in my diet. It has ascorbic properties and when squeezed fresh in warm water first thing in the morning can be unrivaled in beating constipation and alleviating overall lethargy. It is one of the most alkaline forming foods in spite of its acidic taste and it’s available year round. 12. Lettuce: The king of Vegetables. Even plain, they have an excellent taste to them. They are highly perishable though and thus need to be consumed soon after purchase. It is the basis of many a salad and is a great body building food. Mountain gorillas of the Plateau regions of Nigeria and Cameroon subsists primarily on leaves and look at how big and strong they are (of course that’s all they have access too in their habitats and they are much less active than the lowland gorillas of the south of these two African countries who eat mostly sweet fruits and a few leaves) 13. Maple Syrup: Native to the First Americans, this food is a balanced form of positive and negative sugars. There are three grades of maple syrup A, B and C. My recommended grade is B. It contains sodium, potassium, calcium, magnesium, manganese, iron, copper and silicon. Mangoes: As great as this fruit is, eat in moderation though and if you can organically grown and only in season. 4-5 should fill the average person up, but hey if they are too tempting it doesn’t hurt to enjoy. 15. Melons: As a rule Eat melons alone or leave alone. They are one of the fruits that leave the stomach almost as soon as they are ingested and thus should not be combined with other foods, if you must, wait 20 minutes or so and eat Celery or Lettuce. I’m of the firm belief that in the summer times when they peak, a human can subsist on them for days on end. Ensure to get them ripe and enjoy as you desire. I’ve tried a watermelon fast to very rewarding results. 16. Nectarines: Like its close relative, peaches, these stone fruits are excellent in the summer times when they are available and a mono meal of them for a restricted diet can be a camouflaged fast. 17. Pears: A viable winter fruit. It is a sub acid fruit like the apple and is of course loaded with vitamins and minerals. Ensure to eat this fruit only when fully ripe. 18. Pineapples: Look for varieties ripened on the leaves. I’ve not (as of this writing at least) been to Hawaii to taste their crop but, I’ve had the pleasures of them in Nigeria, they are simply great. Being an acidic fruit, ensure to consume them in the earlier part of the day. 19. Plantains: At times known as the potatoes of the air, the varieties grown in Ecuador or the tropical countries are great. They form the staple of many so-called third world countries and can be enjoyed alone or with some plain raw leaves of parsley, lettuce or celery. 20. Potatoes: Some authors have attacked potatoes as being unsuitable for human consumption. Though not the best food, nothing could be further from the truth though. I’ve read and have been in tribes who subsist on root vegetables only; its cousin the sweet potato actually ranks high as an alkaline forming food. In my estimation, boiled and mashed with avocadoes and a dash of sea salt after eating some celery, they are a welcome balance to even excessive sweet fruits and are very nourishing as well. They are also easy to digest and are better than even some so-called raw recipes. They of course are available year round. 21. Tomatoes: Like the potato, it is a member of the nightshade family but unlike it, the tomato is a fruit botanically. Blended with Young Coconuts or Avocadoes, they are excellent for dressing. They are an acidic fruit thus should be eaten in moderation due to their high content of oxalic acids, 2 -3 should suffice and even then every other day. As a rule ensure that all of the above (save for maybe mangoes and avocadoes) are grown organically only. Better health and a safe weight loss need not be things you have to pay an extreme amount of money for. You really dont need any special recipes, worthless and hazardous substances when trying to lose weight. Drugs that block COX-2 alone also block inflammation. There has been concern that blockade of COX-2 may also have deleterious effects such as elevated blood pressure, reduced kidney function, and possibly an increased tendency for heart attack and stroke. Vioxx was removed from the market after concerns regarding the possibility of an increase in cardiovascular problems related to this drug. Celebrex is the only COX-2 drug that remains on the market. It is currently undergoing extensive trials to further evaluate its safety profile. Interestingly, it appears now that all anti-inflammatory drugs share a similar risk for causing cardiovascular events to occur. Another important cause of inflammation are Reactive Oxygen Species. These are also known as oxygen free radicals. These oxygen free radicals lead to the production of pro-inflammatory proteins. One medication undergoing clinical trials is a plant-derived anti-inflammatory product called flavocoxid. This medication apparently has effects on COX-1, COX-2, as well as LOX. Clinical data so far has shown that the side-effect profile is significantly lower than that for other anti-inflammatory drugs. Flavocoxid is a blend of phytochemical compounds derived from fruits and vegetables. The reason is because I believe that those who are in a relationship will be significantly and directly affected in all areas of their life by how that relationship is going, and how healthy that relationship is. Research has proven that those who are happy at home are more productive and less stressful at work. Developing a better relationship with your mate can help you develop a better life and a better business! Here are some thoughts to chew on for developing a strong and healthy relationship with your mate. Listen. Communication is the key to a lasting relationship and listening is the key to communicating. Too often when we are quiet we are not listening, but waiting to speak. Instead of listening to what our mate is saying, and intently trying to understand them, very often we are making mental notes of what we would like to say in response. This is particularly true for us males. We often are trying to find the weakness in our mate’s argument, rather than really listening to the words that they’re saying and the manner in which they’re saying it. Why not take some time this week trying to internalize and understand your mate’s words and feelings? Schedule a regular time to go out or spend time together. With today’s busy lifestyles, it is too easy to put our relationships on the backburner and take them for granted. While we might have every intention of spending regular time with our mate, we often find ourselves driven by a schedule that has us running in every direction and leaving us little time for our most important relationships. Work gets in the way. The kids get in the way. Our hobbies get in the way. We need to realize the value in the importance of that relationship with our mate and its effect on our total life. Then we need to make spending time with our mate a major priority by scheduling a specific time at least each week to get alone together, talk, and simply renew our relationship. In fact, it is probably best if you and your mate sit down and decide what night will work each and every week, then put it into your daytimer. If someone asks you if you’re available at that time, you tell them you already have an appointment. In the long run, that time that you spend with your mate will help you to become more of a success than you could ever mention. Consider your mate’s interests more important than your own. When each person has decided to give of themselves to the other, you form a reciprocating relationship of love, concern, and devotion. When you come to a place where you disagree or where the two of you have differing opinions, try to get to the point where you can consider what your mate likes as more important then what you would like to do. Studies show that some people have barriers built up from past experiences that give them a negative mindset toward exercise and food. RESENTMENT I thought the golden years were supposed to be filled with relaxing things to do, not more activities I usually put off before? Not wanting to exercise is one thing, but resenting exercising can be paralyzing. There are only a small percentage of people that truly like to exercise. And most do it for a sport or profession. Thats usually not true for the average person. Building up resentment toward exercise goes much deeper than just not liking the effort it takes to do it. Resentment brings out a rebellious attitude in us. It is down right maddening that our bodies are aging and we can not do what we used to do! Every say or think that? We feel it and we see it happening right in front of our eyes. Inside, we are like children. We stomp our feet, cross our arms and say, You cant tell me what to do; Ill show you. The sooner you accept the fact that exercise is going to have to be a part of the rest of your life, the more likely you will start the more likely you will continue exercising. Resentment is usually fueled by his cousins: Denial, Pride and Laziness. The best thing to do is never let them play together. Resentment is a form of pride. FAILURE Why should I start exercising? I will not follow throughnever have. It will be just another failure of mine. The only failure is not starting. Success is not measured in numbers. It is measured in your growth through the process. Just because your track record may show some ups and downs has no bearing on your future efforts. Plus, your self-worth is not based on how many times you started an exercise program. Fear of failure is an excuse to never try. PERFECTION Why am I not doing this the way I know I can do this? I might as well not do it at all if I cannot do it right. If you think for one second that you are going to be perfect in sticking to a plan, forget it. Its not possible for anyone. The truth is you will never be perfect. Once you reach a goal, you will have another one. Its a repetitive cycle, like running on a treadmill that will never stop. Perfectionism is an illusion. COMPARISONS Why does Jane look like she does and I have to work so hard at it. It does not seem fair! Life just isnt fair, is it? For some, it seems effortless to look thin and feel healthy. These people may even do the exact workout plan as you and get totally different results than you do. For you, it is a constant trip to the dentists office. You dread it. You know its going to hurt, and it may even cost a lot in the end. You are right that its not fair, but thats life. You need to get beyond this. Comparing yourself to others and your past is a losing battle. EXPECTATIONS Why is it so hard to balance my fitness goals and lifestyle? Unless you have such paralyzing health problems that you cant move, there is NO reason in the world not to get some form of exercise. However, you have to be smart about it and you have to be realistic in what you choose to do. If your expectations are too high, you set yourself up for failure and then begin comparing yourself to others. In some cases, ER sets in before you even start. This is hurtful. Setting expectations that are too high is self-defeating before you even start. Here is what I told them and I will tell you the same - One out of three of you will break a bone. Half of you are on the verge of obesity and diabetes. A third of you will suffer a heart attack. Half of you will end up in a nursing home. And most of you are not living a life filled with confidence, good sleeping patterns, high energy or happiness. Why now? You tell mewhy not now? Do the math! Numbers do not lie. You either accept the road less traveled or you face the consequences. Its just that simple. This may resemble a scare tactic, but the bottom line is this is your reality. If you think for one second you are exempt, above reproach, or just relying on luck or faith, think again. Your best defense is a good offense. Why now? Resenting the need to exercise is a waste of energy. Never starting because you are afraid of failure is a copout. Striving to exercise perfectly is a bit unrealistic for anyone. Comparing your present condition with how you used to be is a losing battle.
